I have had discussions with some members of parliament plus TSC staff who attended the talks between TSC and KNUT yesterday. The headlines IN THE PAPERS THAT TSC WILL FORCE MEMBERS BACK INTO KNUT are  misleading.

FUNCTIONS OF A PARLIAMENTARY COMMITTEE

 

  1. A parliamentary committee cannot order an independent commission. A parliamentary committee investigates, interrogates, advises, summons, arbitrates and reports back to the speaker WITH RECOMMENDATIONS, which have to be debated , passed and forwarded to the president for them to become law.
  2. Parliamentary committee is not a court of law, or the executive arm of government. Neither is it the police. Simply, Parliament legislates. It does NOT EXECUTE. Intact.. TSC is part of the executive arm of govt. Thus, TSC can only execute what is in law. Not what has been discussed in a boardroom and is not anchored in law.
  3. What came out of the meeting mainly was that KNUT HAS TIED ITSELF with numerous COURT ORDERS. TSC has the best interest of ALL TEACHERS. But it cannot go against a court order that clearly ruled KNUT MEMBERS cannot enjoy the benefits of the CBA.

CONCLUSION

The parliamentary education committee advised KNUT to pull out all cases from the court before they can engage with TSC on finding a solution. Withdrawal of cases means, that even cases which Sossion has filed to keep two jobs, and that of his de-registration be withdrawn. Meaning he ceases to be the SG before TSC can engage with KNUT.

BARACK MULUKA REMAINS THE GENTLEMAN OF KENYAN POLITICS

 

Barack has resigned as the sg for ANC. His letter to party leader H.E. Musalia Mudavadi has clearly demonstrated his maturity and the peaceful nature of people from Mulembe nation. Here are the highlights of his resignation letter.

1. This is a very well written letter and full of decorum, if true, it is a very good step. Such should be encouraged.

2. ANC as a party needs to reorganize itself with the aim of ensuring that it has the face of Kenya the next SG shouldn’t ideally be from western or luo nyanza.

3. All other party positions should be equally reevaluated to ensure the right people are at the right spaces, starting with the national level and cascading downwards to the counties.

4. The party should start to assemble a formidable team as officials and part of the secretariat.

5. Go well Mr. Muluka, you did your but and it is fantastic you have given space for others to have the honour and privilege to do their bit. I wish you well in your future endeavors.

CONCLUSION

Expext a more rejuvenatedmuluka ANC Party with the face of Kenya in leadership.

OBJECTIVES OF THE GOLD PETITION GROUP_

Large gold deposits are lying in the ground in Kakamega, Vihiga and Siaya. We believe that this mineral resource will be a gold changer in the lives of our people in Western. But we cannot allow politicians and brokers to take advantage of this resource and keep we the SONS AND DAUGHTERS OF THE SOIL out of it. We want to be part and parcel of the gold mining in Kakamega and Vihiga. ( Citation)

 

We therefore are getting together to do the following.

 

*1. Mobilise* We intend to recruit friends, family,  locals, professionals, those in diaspora etc to add a voice in creating awareness of the impact large scale gold mining will have on residents of those areas. That explains. We welcome you to be part of a larger team that will speak, cry, run, protest, tweet, write, petition and do all that appertains to creating awareness, seeking funding, and being part of the action to reach out to the people of Western on the important resource that God gave them. Specific objective 1: To assess the impact of large-scale gold mining in in the area

 

 

*2. Create awareness*

 

Our people have remained largely ignorant and they just welcome visitors who may be coming to exploit them. Our group is going to reach out on social media, electronic and print media, in churches, villages, and parliament etc to create awareness on the impact of gold mining.

 

Specific objective 2: To provide community sanitation through the use of various social media platform at all levels

 

*3. Petition*

 

We shall petition, parliament, govt, county govts, Acacia Mining etc .. to disclose to us and to the entire world who they are, how tenders are awarded, who are the shareholders etc AND to give full disclosure on details of BENEFITS, compensation,  environmental  reports,  etc that the mining companies will engage in.

 

IT is our right as Kenyans to get information. But corruption in govt makes it very hard for info to be shared. All we want is transparency and accountability in the process.

 

Objective 3: To provide advocacy to various stakeholders in a bid to ascertain the process used to procure mining services by third party companies

 

*4. Environmental And safety concerns*

 

Safety of the lives of people of Kakamega. Those mines in Roster man, Shinyalu etc are a great danger to all the residents. Many are uncovered, others poise huge risks to all. Many have died or maimed working in the mines. We want to know who and how our people will be protected from gases, environmental hazards etc that come with large scale mining.  And this is OUR  key objective.

 

NOTE.Gold needs large amounts of water to process. Water is LIFE. Our rivers, whether patterns etc may be affected because  Gold mines involve excavations of large tracts of soils as they dig the tunnels. There will  be displacements etc.

 

 

Objective 4: To assess the environmental impact of Gold mining  to the environment and the populations at large in the areas

 

*CONCLUSION*

 

The gold mine petition is about starting a conversation to engage all those involved in the proposed gold mining in Kakamega’s Lirhanda belt. This conversation will be actioned packed and is expected to bring results that will be an eye opener to all of us.

 

*WHY WESTERN REGION MUST SUPPORT THE ONE MAN, 0NE SHILLING REVENUE SHARING FORMULA*

The robust debate in the Senate in the past three weeks and the vigilant engagement by ordinary Kenyans on how 15% of the annual budget is shared btw the 47 counties has brought about a level of awareness and engagement never witnessed in our history. Proponents of the formula have argued that money should be allocated based on population while those opposing the formula contend that land mass must also be taken into account since it takes a long distance to render service to people, especially in vast counties

 

*WHAT IS MARGINALIZATION?*

North Eastern Counties combined have a population of 3.3m people and have been receiving a total of Ksh.45B from the treasury as revenue. Compare this with Kakamega and Bungoma whose population is over 6 million but receives Ksh. 30B less than what the northern counties receive. That is where my problem is. I feel bad, when I see my friend Sen. Cleo showing solidarity with the northerners claiming they are marginalized than Kakamega. Marginalisation is an issue older than Counties and cannot be addressed through a revenue sharing formula. Malala cannot use his 5 year tenure in the senate to heal marginalization. Infact he needs to start by defining the term marginalization.

A school with over 3000 students like say Kakamega high school (which has less space), cannot get equal measure of resources with a school like say Garabatula in Garissa which has only 70 students but has a large compound. TSC will post more teachers to KK high, than Garabatula. MOE will send more money to fund projects at KK high than to Garabatula. Kakamega high will look like it is more veloped because the large population will lead to competition, more talents, etc. The head teacher of Garabatula will be very selfish if he comes to Nairobi and demands to get equal share or more funding that Kakamega high because he has more space and he is less developed. Why? Because… developments and funding follows people and settlement.

It is the principal function of the Commission on Revenue Allocation is to make recommendations concerning the basis for the equitable sharing of revenue raised by the national government. The Commission makes recommendations on other matters concerning the financing of, and financial management by, county governments, as required by this Constitution and national legislation.

 

The latest revenue allocation formula seeks to enhance service delivery, promote balanced development, encourage counties to raise their own cash and prudently use public resources.

 

*CONCLUSION*

 

The @KNBStats ranked Kakamega, Turkana and Mandera as top counties with poor people. Turkana(752,359, Kakamega (580,834), Mandera( 513,207. Let ghe people of Western realise that they are very poor because they have a large population, and the resources that reach them are not enough. Malala must fight for Kakamega. Let him let Somali people fight their own war which they have babtized Marginalization. Let Malala also ask those Somali MPs why is it that areas that border Northern Kenya in Ethopia and Somali land are also marginalised? How come Ethopia or Somalia have never been able to solve the marginalization of their regions that border Kenya?

Senator Cheralgei, from Nandi County on the floor of the senate
has reminded the solidarity chorus of senators from Western… who are busy supporting delegations from NEP claiming that nothern Kenya is maginalised.. That marginalization and poverty is MORE IN BUSIA, BUNGOMA and KAKAMEGA than Northern Kenya.

Many Kenyans have been misled to think that pastoralism is synonymous with poverty. Infact, crop farmers… are more disadvantaged in Kenya. You cannot compare someone with 100 carmels 1000 goats etc with a maize farmer in Kakamega with half an acre of land.

As the Luhyia nation, we agree with Cheralgei. We did not vote for Malala to go fight for Turkana county.

*TSC HAS AGREED WITH MAGOHA THAT THE DREAM CALLED NYUMBA KUMI TEACHING IS VALID. HERE ARE THE 10 GUIDELINES IT HAS ROLLED OUT*

 

 

Teachers Service Commission (TSC) has come up with new guidelines as it prepares to roll out free community-based learning. The guidelines have raised more questions and caused more confusion. For example, they are nt clear on the age of teachers who should teach. Covid 19 protocolas are such that those above 50 0r ist 58 are at Risk.

 

They are not allowed to work. The guidelines require teachers to teach for 4 hours. How now? Even churches are only allowed to hold one hour services.  But most important, the guidelines have nothing about fumigation of the learning areas, nothing on how social distancing will be ensured. Nothing on who provides learning materials. Nothing on who will supply learners with masks or water to sanitize. Simply this is a big dream. It is an assumption that COVID 19 does not exist in Kenya.

GUIDES

 

Here are the guidelines.

  1. Teachers will be required to arrange for classes of not more than 15 learners in villages and estates for four hours daily.

 

  1. For teachers to participate in this exercise, they will have to register with education officials within their locality.

 

  1. Under the new community based learning, face to face lessons will take place in open places and halls with strict conformity to Covid-19 containment measures.

 

  1. During the community based learning, teachers will engage learners on life skills and values such as weeding, cultivating, grazing, story telling, hygiene among others.

 

Syllabus Coverage

 

  1. Tutors will have an opportunity to cover the syllabus lost due to prolonged pandemic that grounded to a halt activities in education sector. This is because, learners will be grouped according to their ages and classes. Since learning will be based on group discussions and peer-to-peer emphasis, then grading of learners will be possible. Teachers should use discussion groups during learning and even grading can be done among peers,” read part of the draft guidelines.

 

No Travelling

 

  1. The commission will monitor and supervise community based learning through decentralised system at the regional, county and zonal level.

 

  1. The draft TSC guidelines say the ministry of interior will identify learners and venues for lessons, while that of health will ensure learning takes place in line with covid-19 protocols.

 

  1. Ministry of interior will also ensure no learner fails to participate in the programme. Chiefs together with Nyumba Kumi initiative will assemble learners who will be taught at no cost.

 

  1. According to TSC Guidelines, teachers will be required to register with curriculum support officer CSO and sub county education officers within the area they are currently living. This means that teachers will not be required to travel to their work stations, since they will be assigned duties where they are presently residing.

 

  1. Orientation of teachers on how they will engage learners will be carried out.

 

*CONCLUSION*

 

All dreams are valid. This is one of those dreams that MOE has engaged in. You recall other dreams like Laptops, NEMIS, Free Primary and Secondary Education… etc. Let us help Magoha to keep dreaming.

WAS THE CLEOPHAS MALALA DIRECT CALL TO UHURU KENYATTA ANOTHER PR STUNT?

 

The Daily nation reports that Kakamega Senator Cleophas Malala had a direct phonecall conversation with President Uhuru Kenyatta on Saturday, August 8, as he led protests in the county. Those of us who are political thinkers from the region read mischief in the whole episode.

 

We have seen this before. We saw a senator use direct street phone calls put on speaker to predsident Uhuru Kenyatta to undermine his governor in Nairobi. It worked those days. We doubt if it can work today.

In the phonecall with Uhuru, Malala exposed misappropriation of funds by the county government noting that he had no problem with Health Cabinet Secretary Mutahi Kagwe.

“We do not have any problem with Kagwe’s function, the people are just agitated against the governor, you gave Kakamega Ksh262 million but nothing is being done, Malala is heard telling the president.

“As we speak the isolation centre has no ICU machine, yesterday night they took one ICU machine from the wards and installed it in the isolation centre so that when Kagwe comes today, he will see there is something,” noted Malala.

Malala claimed that residents were being fooled adding there was little to show for the the Ksh105 million appropriated in the supplementary budget.

The protest were triggered by the demolition of kiosks constructed along a road leading to the Kakamega County Teaching and Referral Hospital where CS Kagwe was expected to make his daily briefing on the Covid-19 pandemic.

Malala told Uhuru that all the protesters were asking for was for Governor Oparanya to address all the issues affecting the county.

The Senator added that they would respect the government but would want it to be known that the county is not adequately prepared to battle Covid-19.

“Of course, we will respect the government but what we want is, we have got local issues which Governor Oparanya must be told and also the world to know that Kakamega is not prepared,” added Malala.

The protests disrupted activities at the Kakamega County headquarters as Governor Wycliffe Oparanya was preparing to receive Health Cabinet Secretary Mutahi Kagwe and his Devolution counterpart Eugene Wamalwa.

County enforcement officials swung into action and managed to clear the protesters from the main gate.

*MY TAKE*

These kind of stunts and street phone calls to President Uhuru Kenyatta we have seen before. The embattaled Nairobi governor Sonko used such tactics to impress the electorate when he was senator for Nairobi that earned him a ticket to be governor. Those stunts never saved him when his time to go came. Malala having been a drama teacher, should not use those drama skills to impress us to vote for him as governor in 2022. Let him deliver resources from the Senate to kakamega.

DEATH OF KNUT IS OUR OWN MAKING, LED BY SG SOSSION

Let us accept. We.. And by we, I mean we, THE CURRENT LOT OF teachers, KNUT OFFICIALS and KNUT staff, have contributed in one way or another to the death of KNUT. We did this by accepting an ACTIVIST CALLED WILSON SOSSION TO LEAD US. Truth is, you cannot use an activist like say Okiya Omutata, or Bonface Mwangi or give them a 200 million a month, 1.6 billion a year organisation.

FLASHBACK

KNUT used to be a great union whose leadership had teachers interests at heart. Ambrose Adongo, Okuta, Katumanga, Majali.. They knew how to handle the government. They knew when to strike and when to lay back. A good trade unionist is like my papa Atwoli. Atwoli knows when to strike, he also knows when to woo the govt. Actually, Atwoli works with govt of the day.

ACTIVIST SOSSION
Then, we teachers and KNUT delegated got duped. We accepted to be led by an activist and removed real trade unionist like Mudzo, Jecinter Ndegwa, Mungai Muhia, Dorothy Muthoni, Muna, John Wesonga.. etc.. who had experience of working with govt.. and we brought in an activist, an opposition leader, a political wannabe.. Hon Wilson sossion. SOSSION came with one weapon. Everybody is his enemy. He is the only one who is right. He used the power of the union to fight his personal battles and fears. But more so he used KNUT to fight government policies. Some of these policies had nothing to do with the labour rights of the teachers.

I will never forget, the night of April 2019,_when SG Sossion called me from the city of Liverpool in the Uk to organise and hype up teachers to boycott the NEW curriculum trainings organised by MOE. I pleaded with him to drop the idea. He refused to listen, he got Chungani and Namisi in Western who helped him mobilise teachers to boycott. Many were dismissed. Others have died etc for this very act which HAD NOTHING TO DO WITH LABOUR.

Sossion made himself the SG the chairman the NEC, the treasurer, the technical staff, the propaganda chief… and ignored everyone who tried to advise him otherwise. He would give the government ultimatums without giving any room for negotiations. It was either his way or the highway.

SUICIDE BOMBER

While working at the KNUT HQS, I realised that my friend and brother, Wilson was nothing more than a suicide bomber. He was on personal mission to die with KNUT. I just quit his company. I walked away.
His arrogance had destroyed a great union. He may go round blaming TSC for his woes but the truth is he is the one who has killed this union. The government had had enough of the children being used as HOSTAGES and shields whenever Sossion felt like hitting at Uhuru or Ruto.

CONCLUSION

We can only hope and pray that one day Sossion will leave and teachers can rebuild their union again from a scratch. But my personal feeling is that Sossion is on a mission to die with KNUT. The best would be what Nancy Macharia and TSC did. Get teachers out of KNUT, revoke the recognition agreement and assist other unions and associations like KUPPET, KUSNET, KEWOTA AND KEPSHA to grow. Meanwhile we must prevail on Atwoli to allow KEWOTA to become a union to represent all teachers in making of a CBA.
